The HPD has received approximately 29,000 claims. Each claim is individually researched; all parties with a legal interest in the property have a right to be notified of the claim and to respond; and documents must be verified to ensure they are authentic and confer the rights alleged by each party. The investigation may also include further interviews and verification of the documents submitted. Where appropriate, mediation may be undertaken in an attempt resolve the claim.
The length and complexity of the claims process depends on the nature of the claim itself and whether or not it is contested. Therefore,
it is not possible to determine the amount of time which will take to resolve a claim.
However, approximately 1,000 claims are decided per month, and all claims will be decided by August 2005 and implemented by December 2005.
No, HPD is not mandated to grant such compensation. This jurisdiction to grant compensation for damage to property lies
with the Municipal Courts.
As part of the resolution of the claim the HPD will assist the parties in communicating with each other. This can be done through the HPD or the parties can contact each other directly. However, the HPD does not give out the contact details of parties without their permission.
Further,i nformation on the parties to a claim will not be made available to anyone who is not participating in the claim.
How is my claim processed?
After receipt of a claim, it is published and the current occupant is notified and
invited to participate in the legal process. After interviews
and verification of documentation, the parties' statements are assessed and if
mediation is not successful the claim is presented to the HPCC for adjudication.
