FAQ: BEING NOTIFIED OF A DECISION AGAINST YOUR HOME

 

I have received notice of a HPCC decision.  Can I appeal?

Yes, you may appeal but you must do so within thirty days of being notified of the decision.  You have the right to request the Commission to reconsider its decision on the basis that (a)you possess and can present legally relevant evidence, which was not considered by the hPD/HPCC in deciding the claim originally; or (b) on the ground that there was a material error in the application of the Regulation setting down the rules of procedure and evidence to be followed by the HPD/HPCC in the resolution of your property claim.

If you are an interested party but you did not participate in the original proceedings, and if youcan show good cause as to why you did not participate in the original proceedings, you may request reconsideration of the HPCC's Decision within 30 days of learning of that decision but no later than one year from the date of decision.

A decision by the HPCC is final and cannot be appealed to or reviewed by any other judicial or administrative body in kosovo.

I have received notice that the HPD will evict me from the property where I am living.  Will my housing needs be taken into account?

In such a case,where you inform HPD immediately of your needs, the HPD will take your statement into account as part of its program to administer abandoned properties.
