ADMINISTERED PROPERTIES
The HPD is authorized by UNMIK Regulations 1999/23 and 2000/60 to administer
abandoned residential properties.
Section 12
of the latter Regulation list the detailed process of administration; from
beginning to end.
In short, a residential property can be placed under administration (a) in
settlement of a claim; (b) on the request of the property right holder; (c) on
failure to repossess after an eviction and (d) when the property is abandoned.
For as long as the property is under administration, the rights of possession
are with the HPD. The administration shall be terminated on the request of
the property right holder. Following such request, the HPD will deliver an
eviction order requiring the current occupant to vacate the property within 90
days. The administration of the property legally terminates upon repossession
of the property by the property right holder.
The HPD may issue an eviction order in relation to the property at any time
where (a) the current occupant does not qualify for a housing assistance; (b)
the provided housing assistance has expired; or (c) the beneficiary of housing
assistance ceases to qualify for accommodation or does not comply with the given
terms and conditions.
The HPD makes reasonable efforts to minimize the risk of damage to administrated
property. However, it has no legal responsibility for any damage to property
under administration or loss of or damage to its contents.
